Official Terms and Conditions for "Emma Does Weddings"

Effective Date: [Date of Agreement or Current Date]

The following terms ("Terms") form a legally binding agreement between Emma Does Weddings (referred to hereafter as "Musician," "Performer," or "we") and the client(s) (referred to hereafter as "Client," "Couple," or "you") who have contracted the Musician's services for the event specified below (the "Event").

1. Scope of Service

1.1. Performance Time: The Musician is contracted for a specific duration (e.g., 2 hours, 4 hours) commencing at the agreed-upon start time. Any request for performance extension on the Event date is subject to the Musician's availability and will incur an additional fee of £150 per hour, billed in 30-minute increments, payable immediately.

1.2. Repertoire: The Musician reserves the right to make final decisions regarding repertoire, instrumentation, and performance arrangement to ensure the highest quality delivery. Special song requests not listed in the standard repertoire must be submitted in writing at least 30 days prior to the Event.

2. Payment and Retainer Policy

2.1. Non-Refundable Retainer: A non-refundable, non-transferable retainer fee of 30% of the total contract price, or a fixed amount of £100, is required upon signing this Agreement to secure the date. This fee covers administrative costs, booking refusal, and initial planning, and is credited toward the total contract price.

2.2. Final Payment: The remaining balance must be paid in full at least 7 days prior to the Event date. Failure to remit the final payment by this deadline may be treated as a Client cancellation (Section 3) and forfeit the Event date.

3. Cancellation and Postponement

3.1. Cancellation by Client: In the event the Client cancels the contract, the following fee structure applies based on the date of written notice received by the Musician:

All payments already received by the Musician that exceed the fee due will be refunded.

3.2. Postponement/Rescheduling: If the Client requests to postpone the Event, the retainer fee is transferable to a new date only if: a) The Musician is available on the new date. b) The new date is within 12 months of the original date. If the Musician is unavailable for the rescheduled date, this will be treated as a cancellation by the Client (Section 3.1).

3.3. Force Majeure: If the Musician is unable to perform due to unforeseen circumstances beyond their control (e.g., severe illness, accident, natural disaster, government order), the Musician will make every effort to secure a suitable replacement performer of comparable skill and style. If a replacement cannot be found, all funds paid, excluding the non-refundable retainer, will be returned to the Client. The Musician’s liability shall be limited to the amount paid by the Client.

4. Performance Requirements and Liability

4.1. Environment: The Client must ensure a safe, appropriate, and weather-protected performance area (e.g., adequate shade/tenting for outdoor events; a solid, level surface). The Musician requires access to a standard 240V power outlet within 10 metres of the performance area.

4.2. Adverse Conditions: If the Musician determines, in their sole judgment, that weather or environmental conditions pose a risk to the Musician, their equipment, or the instrument (especially for string instruments, pianos, or digital equipment), they reserve the right to cease performance immediately without refund.

4.3. Client Liability: The Client is responsible for any damage or loss to the Musician’s equipment, instruments, or property caused by the Client, the venue staff, or any Event guest.

5. Copyright and Recording

5.1. Live Performance Rights: The Musician's performance is protected by copyright. The Client acknowledges that this contract is solely for a live performance service.

5.2. Commercial Use: The Client may record the Musician's performance for private, non-commercial use (e.g., wedding video/photos) without extra charge. However, the Client is strictly prohibited from using any recording of the Musician's performance for commercial gain, broadcast, or public streaming without express written permission and additional compensation.

5.3. Musician Use: The Client grants the Musician the non-exclusive right to use any photographs, video clips, or sound recordings taken of the Musician during the Event for marketing, promotional, or portfolio purposes, provided the context remains tasteful and professional.
